This Event is open to all natural persons aged 18 or over, residing in Spain, who must also meet the following requirements (the “Participants”):

• hold an active, verified Venga account, which entails; (i) completing KYC procedures prior to participation, (ii) holding a valid ID and (iii) passing identity checks; and,
• wear something orange that is visible without undressing the day of the Event. The identity of Participants shall be verified exclusively through official documents valid for that purpose. These requirements are an essential condition for eligibility to claim the Grand Prize, and compliance will be verified by Venga. Notwithstanding the foregoing, the following will not be considered Participants for the purposes of these T&Cs and will not be eligible to win the Grand Prize;
• employees, contractors, consultants, agents, and collaborators; as well as employees of its affiliated or associated companies;
• their immediate family members (parents, siblings, spouses/partners and children); and,
• friends or any individuals directly involved in the organization of the Event. In this regard, they may participate for entertainment purposes only, but under no circumstances shall they be eligible to claim the Grand Prize.

Participation is free, and winners are determined solely by physical action performed or by locating hidden objects, not by random draw or chance-based selection. To participate in this Event each Participant must carry out the following actions on the Event Day:

1. follow Venga’s official social media accounts on the Event Day;

2. interpret the clues pointing the current location of the “Golden Tió”;

3. be the first verified Participant to physically reach the final location, and

   follow all instructions necessary to claim the Grand Prize. Accordingly, the winner of the Event shall be the Participant who meets the established participation criteria and demonstrates skill, speed, and effort in the Event’s activities.

The name of the winner will be communicated on the place at the moment of finding “Golden Tió” and via Venga´s official Instagram account: https://www.instagram.com/venga_es/. Upon identifying the first Participant who reaches the final location, the Organizer will carry out an on-site verification consisting of:

• presentation of a valid identification document; and
• confirmation that the Participant holds a fully verified Venga account (KYC). Only Participants who meet these on-site requirements shall be considered the provisional winner. Following the on-site verification, the Organizer will conduct a post-event eligibility review within a maximum period of thirty (30) days. This review shall include:
• confirming that the individual is the natural person associated with the Venga account used to participate in the Event;
• verifying that the provisional winner is not an employee, contractor, agent, collaborator, or family member of such persons; and
• performing any additional compliance, integrity, and anti-fraud checks deemed necessary. If the provisional winner fails to complete the required verifications or does not meet the eligibility conditions set out in these T&Cs, the Grand Prize shall be dismissed and declared void, with no alternate winner designated. Prize is personal and non-transferable; therefore, if the provisional winner does not meet the eligibility requirements or renounces the prize, the Organizer may declare the Grand Prize void without appointing any substitute winner.

The prize of the Event consists of EUR20,000 or its cryptocurrency equivalent (the “Grand Prize”). The Grand Prize is non-transferable and not substitutable under any circumstances. It may not be exchanged for any other prize at the winner’s request, nor may it be assigned or transferred to any third party. To claim the Grand Prize, the winner must comply with all prize-claiming requirements established by the Organizer, including:

1. Holding a fully verified Venga account at the time of claim;
2. Providing valid and current identification documents;
3. Successfully completing all on-site verification steps during the Event, including presentation of valid ID and confirmation of KYC status; and,

4. Successfully completing any additional identity, eligibility, compliance, integrity, and anti-money laundering checks requested by the Organizer during the post-event review period (up to 30 days).

   For Grand Prize delivery, it will be credited within thirty (30) calendar days after successful verification and confirmation of ”Golden Tió” handover upon successful completion of all applicable verification, compliance and anti-money laundering checks required by law,. The Organizer will pay directly via transfer to the winner’s Venga account in either EUR value or the cryptocurrency equivalent. If the winner fails to complete verification, they forfeit the Grand Prize, and it may be awarded to the next eligible Participant.

The data controller for the personal data of the Participants is Venga. During the participation process in the Event, the following categories of data may be processed:

• Identification data: first name, surname(s), identification document (DNI/NIE/passport), image, voice.
• Contact data associated with the Venga account.
• Data derived from eligibility verification (KYC, identity).
• Data generated during the Event: photographs, audiovisual recordings, approximate location linked to the Event dynamics, and any information necessary for its management.
• Data derived from prize delivery (bank details or Venga account details necessary to make the payment). Personal data will be processed for the following purposes:
• Management of participation in the Event, including requirements control, identity verification and communication with Participants.
• Determination and validation of the winner, as well as prize delivery.
• Compliance with legal obligations, including those relating to fraud prevention, if applicable, identity verification, tax obligations or requests from competent authorities.
• Ensuring the safety of the Event, operational control and incident management.
• Recording and dissemination of images obtained during the Event where Participants appear incidentally in general or ambient shots, based on the organizer’s legitimate interest.
• In the case of interviews, direct recordings or content individually featuring a Participant, the processing will only be carried out with their express consent by means of the document set out in Annex I. The processing is based on the following legal grounds:
• Performance of the legal relationship arising from participation in the Event (Art. 6.1(b) GDPR).
• Compliance with applicable legal obligations (Art. 6.1(c) GDPR).
• Venga’s legitimate interest in ensuring the safe conduct of the Event and disseminating general content relating to it (Art. 6.1(f) GDPR).
• Explicit consent for recordings or individualized appearances as provided in Annex I (Art. 6.1(a) GDPR). Data may be disclosed to public authorities and bodies where legally required, service providers to Venga (audiovisual production, technological support, identity verification, communications), acting as data processors, and digital platforms and social networks located outside the EEA (for example, the United States), exclusively in cases where the Participant has specifically consented to their direct appearance in Venga content. In the event of international data transfers, these will be carried out in accordance with the safeguards set out in Chapter V of the GDPR (e.g. Standard Contractual Clauses). Personal data will be retained for the time necessary for:
• Management of the Event and validation of the winner.
• Compliance with applicable legal obligations.
• In the case of incidental images and general promotional material, for the period necessary for the purposes of dissemination and legitimate promotion of the activity.
• In cases where specific consent has been granted (Annex I), for the time necessary to fulfil the purposes described in such authorization. Participants may, at any time, exercise their rights of access, rectification, erasure, objection, restriction of processing, data portability and withdrawal of consent (where applicable). Requests may be sent to: [email protected], together with a copy of a valid identity document. Participants are also entitled to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es). Venga implements appropriate technical and organizational measures to ensure the security, integrity and confidentiality of personal data, in accordance the GDPR.
